1. Who we are

DARWISE PROPERTIES L.L.C (Trade License No. 1634778, RERA ORN 62940), registered at Office 903-X15, Iris Bay, Business Bay, Dubai, United Arab Emirates ("Darwise", "we", "us"), is the controller of personal data processed through this website and our related services. We process personal data in accordance with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL) and other applicable UAE laws.

2. What we collect

• Contact and identity data: name, email, phone number, nationality, and, where a transaction proceeds, Emirates ID, passport, visa, and related KYC documents
• Property requirements and transaction data: search criteria, saved properties, enquiries, valuation requests, offers, transaction history, and payment references (we do not store full card details)
• Communications: emails, calls, WhatsApp and chat messages with us, including messages handled by our AI systems, and records of any correspondence
• Recruitment data, if you apply to work with us (such as your CV and qualifications)
• Technical and usage data: device information, IP address, browser type, and how you use the Platform, collected via cookies and similar technologies (see Section 10)
• Source of funds and beneficial ownership information where required by UAE AML law
• Any other information you choose to provide to us

If you provide us with personal data about another person (for example, a co-buyer, tenant, or landlord), you confirm that they have been informed of this policy and, where required, have consented.

3. Why we process it and on what basis

• To respond to enquiries and provide brokerage and related services (performance of a contract or steps at your request)
• To match you with properties and provide estimates and market information, including using AI-assisted analysis (legitimate interest / consent where required)
• To comply with legal obligations, including DLD/RERA requirements and AML/CFT customer due diligence, transaction monitoring, and reporting under UAE law (legal obligation)
• To send marketing communications about properties and services, only with your consent, which you may withdraw at any time
• To operate, secure, improve, and personalize the Platform and our services (legitimate interest)
• To establish, exercise, or defend legal claims (legitimate interest)
• For any other purpose described to you at the point of collection, or with your consent

4. Automated processing and AI

We use AI systems to assist with responding to enquiries, matching properties, and supporting our brokers. AI outputs are used to assist our licensed brokers; decisions with legal or significant effect on you (such as entering a transaction) are not made solely by automated means. You may request human review of any AI-assisted interaction.

5. WhatsApp and other messaging

If you provide your number and opt in, we may contact you via WhatsApp using the WhatsApp Business Platform (provided by Meta). Message content and metadata are processed by Meta under its own terms. You can opt out at any time by contacting us.

6. Who we share data with

• Our staff and licensed brokers, on a need-to-know basis
• Our group companies and affiliates
• Service providers acting on our instructions: hosting, CRM, communications (including Meta for WhatsApp), analytics, advertising, payment processing, and IT support
• Developers, landlords, or counterparties, to the extent necessary to progress a transaction you have requested
• Government authorities and regulators (DLD, RERA, the UAE Financial Intelligence Unit, courts) where required by law
• Professional advisers under confidentiality obligations
• A buyer or successor in the event of a merger, sale, restructuring, or transfer of some or all of our business or assets
• Other parties where necessary to protect our rights, property, or safety, or those of our clients or others, including for fraud prevention

We may share aggregated or anonymized information that does not identify you without restriction.

7. International transfers

Some of our service providers process data outside the UAE. Where personal data is transferred internationally, we do so in accordance with the PDPL, using destinations or safeguards permitted by the UAE Data Office requirements, contractual protections, or your explicit consent where applicable.

8. Retention

We keep personal data only as long as necessary for the purposes above. Note: where UAE AML law applies, we are legally required to retain customer due diligence records and transaction documentation for at least five (5) years after the end of the business relationship or transaction, and this retention obligation prevails over deletion requests for those records.

9. Your rights

Subject to the PDPL and applicable exemptions, you have the right to access your personal data, request correction or deletion, restrict or object to processing, request data portability, and withdraw consent (without affecting prior processing). Deletion and objection rights do not apply to data we must retain by law (see Section 8). To exercise any right, contact privacy@darwise.io. We will respond within the timeframes required by law. You also have the right to lodge a complaint with the UAE Data Office.

10. Cookies

Cookies are small files of letters and numbers stored on your browser or device that help us distinguish you from other users, operate the Platform, and improve your experience. We and third parties use the following categories:

• Strictly necessary cookies: required for the operation of the Platform, such as security, session management, and access to secure areas. These do not require consent.
• Analytical/performance cookies: allow us to recognize and count visitors and understand how the Platform is used, so we can improve how it works.
• Functionality cookies: recognize you when you return, remember your preferences (such as language, saved properties, or region), and personalize content.
• Targeting/advertising cookies: record your visit, pages viewed, and links followed, to make content and advertising more relevant to you on our Platform and elsewhere. This information may be shared with advertising partners.

Third parties (such as analytics providers and advertising networks) may set their own cookies through the Platform, which we do not control.

You can manage or refuse cookies through your browser settings or, where displayed, our cookie banner. Refusing certain cookies may limit parts of the Platform. Where required by law, non-essential cookies are used only with your consent.

11. Security

We apply appropriate technical and organizational measures to protect personal data, including access controls, encryption in transit, and staff confidentiality obligations. No system is perfectly secure; if a breach occurs that risks your rights, we will notify the UAE Data Office and affected individuals as required by the PDPL.

12. Children

Our services are directed at persons 18 and over. We do not knowingly collect data from minors.

13. Changes

We may update this policy from time to time. The current version will always be published on the Platform with its effective date.
